We all have one thing in common – we regularly go to the store. In 99.9999% of cases, we will be served politely and will smile back. I propose to talk about those rare moments when this does not happen.
Sometimes relations with the seller find themselves on the border between two legal norms – the right to private property of the owner of a shopping center and the right of a citizen to own his property. Most often this occurs when a buyer collides with a security guard who is suspicious of this buyer. The escalation of the conflict occurs due to ignorance by both parties of their rights and obligations before the law.
It's funny, but 10 years ago, people could not record events by simply taking their phone out of their pocket. It is progress that has highlighted the problems of society and made them public.
Let's consider the position of each side of the conflict. Buyer:
Has the right to enter any store during his working hours and buy anything (within the law), even if the seller does not like it personally. Nobody has the right to deny him service. In this case, the buyer must pay before leaving the building. There are no clear legal norms, but from legal practice – went out for the cashier and did not pay, then he stole and this is fair. The buyer can conduct audio, photo and video filming of everything inside the store, despite the protests of the seller or the administration. This right is given to him by Clause 4 of Article 29 of the Constitution of the Russian Federation, which has been repeatedly proved during court hearings throughout the territory of our state.
Security guards, sellers and administrators in their activities are guided by job descriptions, which are written to them by the management. At the same time, no one cares that sometimes they are required to violate the laws of the Russian Federation. And this is the main reason for most conflicts. All searches in supermarkets, grabbing by clothes and illegal use of physical force are the consequences of legal illiteracy. I can argue that most of the security guards do not know that they are obliged to present a private security guard certificate to a citizen at his request (clause 5 of article 12.1 of the Federal Law 'On private detective and security activities in the Russian Federation No. 230-ФЗ dated July 13, 2015').

I propose not to discuss the above, this is already an accomplished reality. Much more interesting, in my opinion, is the personality of such streamers. Why are they doing this? For making money? The number of subscribers for most of them does not allow this. So what for? What are their motives? Do they do this for the sake of raising the self-awareness of citizens, or do they just enjoy trolling the guards (most of whom are much older than them)? Or maybe these are real patriots who want to make the country better? Why, once finding themselves in a similar situation, some citizens regularly continue to fight for their rights? Or is it just extreme entertainment?
